Newsmax Sues Fox News, Alleges Antitrust Violations

Newsmax filed an antitrust lawsuit against Fox News, claiming Fox used intimidation and exclusionary practices to stifle competition and maintain market dominance. Newsmax alleges Fox blocked distribution, pressured guests, and investigated executives. Chris Ruddy, Newsmax CEO, commented on the situation.

Newsmax, a conservative news network, has initiated legal action against Fox News, alleging antitrust violations. The lawsuit, filed in a Florida federal court, claims Fox News engaged in anti-competitive behavior to protect its market share.

The complaint details several actions Fox News allegedly took to hinder Newsmax‘s growth. These include pressuring television distributors to either exclude Newsmax from their channel lineups or make it difficult for viewers to find the network.

Fox News is also accused of using its influence to prevent Newsmax from expanding onto streaming platforms such as Hulu, Sling, and Fubo. Furthermore, the lawsuit alleges that Fox News employed tactics to discourage guests from appearing on Newsmax.

Newsmax‘s legal team contends that Fox News‘s actions constitute a clear abuse of its dominant market position. They argue that such behavior violates antitrust laws and restricts consumer choice. The network is seeking a jury trial to resolve the matter.

The lawsuit also alleges that Fox News used a third-party agency to create social media accounts that targeted Newsmax CEO Chris Ruddy, and hired private investigators to conduct surveillance on Newsmax executives. Newsmax claims these actions were part of a broader campaign to discredit and undermine the company.

Fox News responded to the lawsuit by stating that Newsmax‘s legal action is a response to its own market failures. The network maintains that its success is due to its ability to attract viewers, not through anti-competitive practices.

Chris Ruddy, in a prepared statement, indicated that Newsmax believes Fox News‘s alleged tactics have been ongoing for some time. He suggested that the network’s actions are no longer acceptable.

While acknowledging that Newsmax has not yet rivaled Fox News in terms of viewership, court documents from previous lawsuits indicate that Fox News executives expressed concern about Newsmax‘s potential to gain viewers dissatisfied with Fox News‘s coverage following the 2020 presidential election. This concern, according to Newsmax, further underscores the motivations behind Fox News’s alleged actions. The outcome of the lawsuit remains to be seen.
